Purchasing from our website or catalogues

Currently we only sell and ship within Canada.

Your order constitutes an offer to purchase goods from the Company. No contract for such goods is formed until we accept the order by shipping the goods to you. Due to the nature of our customized products and the unique aspects of creating craft adult goods from liquid silicone rubber, the customer also accepts that each product will have its own unique surface features, coloration, and hardness (as this can be influenced by pigment used to create a good). Due to the nature of the products we offer, there are no returns on goods that customers place orders for and all sales are considered final.

It is your responsibility to verify that your email address is correct and working. You assume the risk of all consequences for transmission or operational failures.

Data Protection

Please note that by sending us your order, you allow us to use your personal details in order to supply the goods to you (which may involve passing them on to relevant third parties such as delivery firms), for marketing and other purposes. We will ask for your permission if we wish to use your details for any other reason (and you may ask us in writing to remove your details from our system by writing to us at our address). We will not sell your details onto a third party.

Price

The price shall be the price quoted on the website except for when we make an error. If we have made an error, then we will inform you of this as soon after you have placed your order as possible and will tell you the correct price, asking you if you still wish to place your order with us. If we have not heard back from you within 7 days, then we will presume that you did not want to place your order again with us and we will give you a full refund if you have already paid.

You may be required to pay extra for shipping and delivery and this charge will be added at the checkout page.

Payments and Delivery

Payments can be made with your credit card information. Your charges will be billed as ‘Singularity Industries Incorporated’, and will show up as ‘Singularity Industries Incorporated‘ on your card statement. Your card will be charged as soon as your order has been placed.

We will deliver to the address given to us by you when you place your order (only within Canada). We aim to dispatch all orders within 2 to 7 days once manufactured. However as with all mail order companies, please allow a little longer for couriers such as UPS, FedEx and Canada Post to deliver your order. Therefore please allow 28 days for delivery. Our average delivery time is under 7 days for Canadian postal codes.

We reserve the right to refuse to deliver to any address other than the billing address, however in the majority of cases we will deliver to the delivery address the customer has requested.

All claims for shortages and damages must be reported to our customer service department within 14 days of receiving the goods. This does not affect your statutory rights as a consumer – and if you overshoot this a little we might still be able to help.

Orders are dispatched from our premises Monday to Friday, and we manufacture 5 days a week (with weekends as off days). This means, depending on stock levels and demand, that custom orders may take from between 6-8 weeks to manufacture and dispatch. This can sometimes be higher, if we have a backlog of such orders.

Reviews

By submitting a review via our website, you are granting the Company a perpetual, worldwide, exclusive license to publish and distribute that review on the Company’s website. If you wish to remain anonymous in your review, then you may request this by checking the ‘Anonymous’ review box in the review submission form. To do this, please submit a ticket using our Contact Form including the email address you use to log into the the Company website, your order number and the details of the toy under review, along with a full explanation as to why you wish to have your review taken down. Please note that this is offered as a courtesy at our discretion; as per the Terms you agree to when you submit the review, we want you to be sure you are comfortable submitting information in your review which will remain online forever.

Limitation of Liability

Singularity Industries Incorporated’s products and toys for intended for adult use only. None of the descriptions used should be interpreted as instructions or directions for the use of the product. It is your responsibility to use the products safely and within your capabilities. The company’s products are provided without any guarantee or warranty. Gift Certificates

The Company Gift Certificates must be redeemed online on the untamedcanadianwild.com website. Gift Certificates are redeemable only as store credit to purchase any items on the the Company website, subject to the restrictions listed in the Store Credit section of these Terms.

The Company will provide Gift Certificate purchasers with information about the redemption status of the Company Gift Certificates that they purchase. To view the Company Gift Certificate balances, visit ‘My Account’ on untamedcanadianwild.com.

Limitations

Gift Certificates cannot be copied, reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law.

Gift Certificates can only be redeemed in their entirety. Thus, if you have a $100 gift certificate, you must redeem all $100 into store credit on any one account.

Gift Certificates do not expire.

Risk of Loss

The risk of loss and title for Gift Certificates passes to the purchaser upon our electronic transmission to the purchaser, or the recipient or delivery to the carrier, whichever is applicable. The Company is not responsible for gift certificates that are lost, stolen, destroyed or used without your permission.

Fraud

The Company retains the right to close customer accounts, cancel orders and/or bill alternative forms of payment if a fraudulently obtained the Company Gift Certificate is redeemed and/or used to make purchases on untamedcanadianwild.com.

Limitation of Liability

Singularity Industries Incorporated (“the Company”) and its affiliates make no warranties, express or implied, with respect to untamedcanadianwild.com gift certificates, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event an untamedcanadianwild.com gift certificate code is non-functional. Your sole remedy, and our sole liability, shall be the replacement of such untamedcanadianwild.com gift certificate. Certain state laws do not allow limitations of implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.

Disputes

Any dispute relating in any way to the Company Gift Certificates will be governed by and construed under the laws of the PROVINCE OF BRITISH COLUMBIA without regard to choice of law provisions. By purchasing, receiving or redeeming a Gift Certificate you irrevocably and unconditionally submit to the jurisdiction of the LAW COURTS OF BRITISH COLUMBIA and of the GOVERNMENT OF CANADA and agree that any legal action or proceeding relating to a Gift Certificate may be brought only in such courts.

Store Credit

Singularity Industries Incorporated allows you to maintain a ‘store credit’ balance associated with your untamedcanadianwild.com online account. This store credit can be used to pay for anything on the the Company online store, subject to the following exceptions:

Unused Store Credit cannot be transferred.

Store Credit does not expire.

If for some reason you are unable to complete payment for your order with store credit, you can resume the checkout from the ‘Open Orders’ section of ‘My Account’. You will also be able to change the payment method used for any partial payment or if you have additional store credit, you may apply this to your order.

General

The benefit of any contract entered into with us is personal to you and only you can enforce the contractual terms.

Availability of goods you order

If we are unable to provide you with the goods you have ordered, you will be contacted as soon as possible, at which point you will be offered the choice of accepting substitute goods of equivalent value or a complete refund of any sums that you have paid.

Cancellation and Return

Due to the nature of the products we sell we only accept returns on items that are discrepant from what was initially advertised on the company’s website, which of course we will be happy to replace. Contact us if you find yourself in this situation and we’ll do our best to help you out.

We reserve the right not to refund our standard shipping charge if items are returned for refund.

Please remember that you have a duty of care with any goods that are in your possession which you intend to return. We therefore recommend that you ensure all returns are made with the original packaging to ensure that the product is not damaged. Failure of this may result in an excess charge being made to cover the repackaging costs and any loss in value of the item.

Should you choose to return an item to us we recommend that you send it via a Recorded delivery method to ensure its safe return. Please include an explanation for the return of the items in the package to limit any delay, along with the email address you ordered from us with.

All cancelled orders are subject to a minimum 20% restocking fee at our discretion.

Delivery

We will deliver to the address given to us by you at the time you place your order (currently we only sell and ship within Canada). We aim to dispatch all orders within 2 to 7 days once manufactured. However as with all mail order companies, please allow a little longer for couriers such as UPS, FedEx and Canada Post to deliver your order. Therefore please allow up to 28 days for delivery. Our average delivery time is under 7 days for Canadian postal codes with International times subject to location and courier service chosen.

We will not be under any liability to you for any delay or failure to deliver if the same is wholly or partly caused directly or indirectly by circumstances beyond our reasonable control. We also will not be under any liability to you for additional customs charges levied should the delivery address be outside of the United States.

We strongly suggest that, upon receipt, you inspect the goods and advise us if the delivered goods are not what you ordered or are faulty.

We will not be liable under our agreement with you for any loss or damage caused by us or our employees or agents in circumstances where i) there is no breach of a legal duty of care owed to you by us or by any of our employees or agents; ii) such loss or damage is not a reasonably foreseeable result of any such breach; iii) any increase in loss or damage results from breach by you of any of these Terms.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of profits or loss of opportunity).

As a consumer, you have certain rights by law regarding the return of defective goods and claims in respect of losses caused by any negligence on our part or our failure to carry out our obligations. These terms and conditions shall not affect those rights.
